The Pennsylvania Supreme Court overturned the dismissal of a lawsuit challenging the constitutionality of a ban on Medicaid-funded abortion and held that the ban must survive heightened scrutiny under the state’s equal rights amendment. On remand, the lower court found that reproductive autonomy is a fundamental right and that the ban does not survive strict scrutiny, concluding that the ban violates both the amendment and the state’s equal protection provision.
