Anderson v. Clarke

Habeas petitioner claims that state Department of Corrections wrongly interpreted a budget provision to apply retroactively, which negated sentence credits earned by many prisoners prior to the budget becoming effective, in contravention of state constitution’s ex post facto and due process clauses. A trial court dismissed the petition. An appeal is pending before the Virginia Supreme Court.
