Ex parte Jackson Hospital & Clinic

Docket number
SC-2023-0601
Date

Ruled that the Governor’s emergency proclamation limiting healthcare providers’ liability for negligence as to COVID-19 was neither unconstitutional under the separation-of-powers clause nor the provision that only the Legislature could suspend laws. Any application of the Alabama COVID Immunity Act to the wrongful death claims brought by the claimant also did not violate the constitutional prohibition on curtailing a right to a remedy after an injury had occurred and a right of action had vested.
