June Medical Services v. Landry
Plaintiffs claim that abortion bans violate the state constitution’s 1) guarantee of due process — the laws are insufficiently clear (Art. I, § 2) and 2) prohibition on unlawful delegation of legislative authority to determine whether the bans have gone into effect (Art. I, § 1). After a trial court preliminarily blocked the bans, an intermediate appeals court stayed the injunction pending appeal, allowing the bans to take effect. The Louisiana Supreme Court summarily upheld the intermediate appellate court ruling, after which the intermediate appellate court reversed the preliminary injunction
