People v. Lopez

Docket number
22SC759
Date

Held that a defendant seeking to establish a violation of their constitutional right to conflict-free counsel is required to show both a conflict of interest and an adverse effect resulting from that conflict under the applicable framework set forth in West v. People, 341 P.3d 520 (2015). According to that framework, unless a matter falls within one of the limited scenarios in which the Colorado Supreme Court has presumed prejudice, a defendant must show both a conflict of interest and an adverse effect resulting from that conflict.
