Sumrall v. State
Ruled that the provision requiring prosecuting attorney’s consent to retroactive first-offender treatment did not violate the Georgia Constitution provision providing that no person shall be deprived of right to prosecute or defend their cause in any of the courts of the state, where the constitutional provision did not provide the right of access to courts, but a right of choice between self-representation and representation by counsel, and the defendant was able to freely execute that choice but did not meet the threshold consent requirement for the hearing to be held on his petition.
