Bain v. City of Cheyenne
A City Transit bus collided with the plaintiff when he was operating a motorcycle. The City admitted liability but asserted damages were capped at $250,000 under a provision of the Wyoming Governmental Claims Act which limits governmental liability to $250,000 per claimant for a single occurrence. The court, held that the provision was a limitation on the scope of the waiver of governmental immunity under the Wyoming Governmental Claims Act, rather than a limitation on damages, and thus did not violate Article 10, Section 4(a) of the Wyoming Constitution, which prohibits the enactment of laws limiting the amount of damages to be recovered for causing the injury or death of any person.
