Beshear v. Coleman

The Kentucky Supreme Court held that laws shifting appointment authority for two state boards from the governor to other executive branch officials violated separation of powers. The legislature exceeded its state constitutional power to prescribe the manner of appointments for inferior officers, the court held, because the statutes did not “preserve a chain of accountability sufficient to allow the discharge of the Governor’s constitutional duty to ensure faithful execution of the laws.”
