A district court dismissed with prejudice a motorist’s negligence action after she failed to pay attorney fees that the court imposed as a sanction for her violation of a stipulated order. Held that impecuniosity following an award of sanctions did not violate the open courts provision of state constitution, which guarantees a right to access state courts. The open courts provision does not grant an individual full legal redress for all claims; rather, the provision guarantees access to the court — which the litigant had when she filed her complaint and testified at trial.
