Held v. Montana
Plaintiffs claim that state’s energy policies, which prohibit agencies from considering the impact of fossil fuels or climate change in environmental assessments, violate their state constitutional rights to a clean and healthful environment, substantive due process, individual dignity, equal protection, and to be beneficiaries of public trust resources. In August 2023, the trial court ruled in favor of the plaintiffs following a bench trial.
