Idahoans United for Women and Families, which sought to qualify a voter initiative titled the 'Reproductive Freedom and Privacy Act’ for the 2026 general election ballot, argued that the Fiscal Impact Statement and ballot titles prepared by the Division of Financial Management and Attorney General did not comply with Idaho law. Idaho Code section 34–1812 requires DFM to prepare an unbiased, good faith Fiscal Impact Statement that is clear, concise, and avoids legal and technical terms whenever possible. Idaho Code section 34–1809 requires the Attorney General to prepare ballot titles that are distinctive, comprehensive, and not argumentative or prejudicial. The Court concluded that Fiscal Impact Statement did not comply with Idaho Code section 34–1812. It also concluded that the long ballot title substantially complied with Idaho Code section 34–1809, but the short ballot title did not.
