The Montana Supreme Court held that it did not violate separation of powers for the state attorney general to be subject to professional conduct rules for his performance as an attorney, including because the state constitution expressly requires the position to be “an attorney in good standing.” The court affirmed the state practice commission’s findings that the attorney general had committed two ethics violations but rejected its recommended discipline, finding the commission had violated the attorney general’s procedural due process rights.
