McNabb v. Harrison
The Tennessee Supreme Court held that the state constitution requires a candidate running for municipal judgeship to be a resident of the same municipality to which he will be assigned, both at time of the election and for one year prior.
Following a February 2026 intermediate court decision, litigation continues on remand regarding the constitutionality of a 2025 statute providing that the Tennessee high court’s decision applies only prospectively and is unenforceable until the next regularly scheduled election for any affected municipal judgeship.
