Ruled that trial court lacked constitutional jurisdiction when it resentenced defendant pursuant to intermediate appellate court’s order while defendant’s application for leave to appeal was pending in state supreme court, as the effect of defendant’s appeal while pending was to divest the trial court of jurisdiction over those aspects of the case involved in the appeal
