The Promenade D'Iberville, LLC v. Jacksonville Electric Authority
Promenade D’Iberville, LLC, which owns a retail shopping center in Mississippi, sued a Florida public utility called Jacksonville Electric Authoriuty for allegedly supplying defective soil used during the shopping mall’s construction. The Mississippi Supreme Court reversed the lower court’s decision to dismiss the case, fiding Mississippi law holds that foreign governmental entities enjoy no greater status under its tort law than similarly situated defendants absent compelling public policy considerations. Theefore, the court allowed Promendate to proceed with its claims.
