The Iowa Supreme Court ruled that a trial court acted beyond its authority when it did not accept a public defender office’s representation that it had a “temporary overload of cases” — a statutory condition requiring the office to withdraw from cases. To avoid separation of powers concerns, the court said, a judge should be highly deferential to that representation, absent reason to believe there are misrepresentations.
