State v. Albaidhani
The South Dakota Supreme Court held that officers who were shot at during a police chase qualify as crime victims for purposes of the state’s Marsy’s Law and are entitled to request that their names be shielded from public filings. While victims have a right to request redaction under Marsy’s Law, the court said, a judge must balance that right against other constitutionally-protected rights, including those of the defendant and public.
