The New Mexico Supreme Court held that the state’s search and seizure clause and exclusionary rule apply to to evidence obtained from a search conducted in another state if that evidence is introduced in a New Mexico state criminal prosecution, even if the search was proper under the other state’s constitutional law. The court relied on and reaffirmed precedent finding that the state clause applies to searches and seizures conducted by federal agents when resulting evidence is later introduced by state prosecutors in state court.
