State v. Chadwick

Docket number
20190818
Date

Held that in multiple acts case when counts charged are identical, the jury must be specifically instructed that it must be unanimous regarding both the conduct supporting conviction on each count and the defendant’s guilt. Because the instructions the jury received in defendant’s trial failed to so instruct, it undermined the court’s confidence in the unanimity of the verdict in violation of the Unanimous Verdict Clause and the conviction must be vacated.
