State v. Gantnier

Docket number
Ken-24-482
Date

Defendant convicted of unlawful sexual contact was erroneously committed to register as a sex offender for ten years but was actually subject to life-time sex offender registration. The court held that the provision of the erroneous judgment and commitment form was not part of the criminal sentence, and thus, the retroactive application of the amendment authorizing the State Bureau of Identification to correct the error did not implicate the prohibition against ex post facto laws. The dissent would have treated the ten-year registration as part of defendnat’s sentence.
