Established that the state constitutional right to a jury trial is coextensive with jury rights that existed at common law at the time the Kansas Constitution was adopted. Held that failure to instruct the jury on an element of a charged crime creates a rebuttable presumption of prejudice but is not grounds for automatic reversal
