State v. Jacques

Docket number
SC 20781
Date

The defendant was convicted of murder in 2016, but the Connecticut Supreme Court reversed the conviction and remanded the case for a new trial due to the improper admission of illegally obtained evidence. After the defendant was retried in 2022 and again convicgted of murder, he appealed the second conviction by arguing, in part, that his state constitutional right to a probable cause hearing was violated. The court held that the defendant was not entitled to a second probable cause hearing because the reversal of his first conviction did not invalidate the original probable cause determination, and the defendant failed to demonstrate a jurisdictional defect.
