State v. Mahana

Docket number
No. 24–0239
Date

The Iowa Supreme Court held that the state’s so-called “felon-in-possession” law was not facially invalid under a 2022 amendment requiring strict scrutiny review of gun restrictions. The court concluded the law satisfies strict scrutiny in at least some applications, including when a person has committed one or more serious violent offenses. The court also rejected an as-applied challenge.
