State v. Roberts

The Oregon Supreme Court held that when the state fails to appoint counsel for an indigent criminal defendant for an extended time period, it violates the right to counsel. The court also imposed a new rule generally requiring charges to be dismissed without prejudice when the state fails to provide counsel for more than 60 days in a misdemeanor case or 90 days in a felony prosecution.
