The defendant was arrested by Belizean police and deported to the United States to stand trial for killing his former girlfriend. He was subsequently convicted by a jury in Nebraska of first degree murder, use of a deadly weapon to commit a felony, and tampering with physical evidence. The court affirmed his conviction, reasoning that Article I, section 7 of the Nebraska Constitution, along with the Fourth Amendment and its exclusionary rule, did not generally apply to searches and seizures conducted by foreign officials in foreign nations unless U.S. law enforcement’s participation constitutes a “joint venture.”
