State v. Scullark

Docket number
23-1218
Date

An officer investigated a domestic abuse call involving teh defendant, who was wearing a fanny pack at the time. Before being handcuffed, the defendant removed the fanny pack and handed it to a companion. The officer allowed the handoff to avoid escalating the situation but later retrieved the fanny pack. Officers searched the fanny pack outside the residence and found methamphetamine inside, leading to charges. The court concluded that the search was reasonable under both the Fourth Amendment and article I, section 8 of the Iowa Constitution because the search was contemporaneous with the arrest and that officers are not required to search items immediately if doing so would compromise safety.
