State v. Stubbs
The defendant was charged with attempted first-degree murder, aggravated burglary, criminal use of a weapon, and interference with law enforcement. The jury acquitted him of attempted murder and aggravated burglary but convicted him of criminal use of a weapon and interference with law enforcement. He subsequently challenged his conviction, arguing K.S.A. 21–6301(a)(2) was unconstitutionally vague. The court held that the defendant had standing to bring his facial vagueness challenge but rejected the challenge on the merits, finding that K.S.A. 21–6301(a)(2) provided adequate enforcement standards.
