New York’s highest court held that there is a promise to pay prevailing wages implicit in every public works contract that workers may enforce with a third-party beneficiary breach of contract claim, and that agreements to shorten limitation periods are unenforceable against such claims. The court based its ruling on a state constitutional clause requiring public works employees to be paid “the rate of wages prevailing in the same trade or occupation in the locality.”
