Featured Cases
Black Voters Matter v. Byrd
Florida Supreme Court upheld the state's 2022 congressional map against voting rights groups' challenge that it diminishes Black voters' ability to elect candidates of their choice in violation of a 2010 amendment, finding the plaintiffs had not proven the possibility of drawing a remedial map that complies with the federal equal protection clause.
Evers v. Marklein
Wisconsin Supreme Court held that statutes permitting a legislative committee to pause, object to, or suspend administrative rules for varying periods of time both before and after promulgation — used by the committee in this case effectively to block for three years a rule banning “conversion therapy” for LGBTQ+ patients — facially violate the state constitution’s bicameralism and presentment requirements.
Kaul v. Urmanski
Wisconsin Supreme Court held that an 1849 law, which a local prosecutor had claimed was a near-total abortion ban, is impliedly repealed as to abortion by subsequent legislation and does not ban the procedure in the state.
Sheffield v. Detroit City Clerk
Held that a governor stopping city charter revisions from being submitted to voters would conflict with constitutional clauses vesting cities with control over their charters
Myers v. Reno Cab Co.
Ruled that employee status for constitutional minimum wage amendment is determined by totality of circumstances, and provision entitling aggrieved employees to all available remedies only applies to claims under the amendment.
People v. Washington

Taxpayers for Michigan Constitutional Government v. State
Ruled that state payments to school districts are included in total state spending for purposes of constitutional spending requirements, but charter schools are not school districts for purposes of the amendment
State v. Wright
Held that a warrantless search of a citizen's trash left out for collection violates the state constitution
Edwards v. Thomas

Velazquez v. University Physician Associates

Smith v. Isakson
Ruled that courts must look to offense's historical nature and the severity of the penalty to determine whether right to jury trial was preserved for the crime
Odyssey 2020 Academy, Inc. v. Galveston Central Appraisal District
Ruled that the state constitution does not permit a property tax exemption for a charter school
