Montana Supreme Court will consider whether a law against obstructing a peace officer violates federal and state speech protections as applied to a defendant arrested while recording on his cellphone police conducting a traffic stop in a public place. The defendant also alleges that his calling an officer a “tyrant” during his argument with the police about the recording is protected speech, so was an improper basis for an obstruction criminal charge.
