Kendrick v. Knudsen
The Montana Supreme Court reversed the attorney general’s determinations that a proposed right-of-direct-democracy initiative violates the separate-vote requirement and requires a fiscal impact statement. The court found that provisions of the initiative that create a new fundamental right to exercise the initiative power and define procedures for protecting and implementing that right are closely related.
