Genser v. Butler County Board of Elections
Held citizens whose mail-in ballots were disqualified for a failure to return them in the required secrecy envelope have a right to cast a provisional ballot and have it count.
Gonzalez v. Miller
Unanimously affirmed the denial of a district attorney’s effort to dismiss a state Open Records Act request relating to her office’s “failure . . . to effectively prosecute criminal cases, and an open disregard for the laws of the State of Georgia"
Republican National Committee v. Eternal Vigilance Action, Inc
The Georgia Supreme Court left in place a lower court ruling that several controversial new election rules are “illegal, unconstitutional, and void.” The rules would have made election certification discretionary, required hand-counting the number of ballots, made drop boxes harder to use, and expanded the role of poll watchers. The appeal will proceed on a normal schedule, which means the state supreme court will fully consider the challenge against the rules over the next few months.
Villafana v. State
Ruled that defendant’s consecutive sentences upon conviction for sexually abusing a child on multiple occasions did not constitute cruel or unusual punishment
State v. Reddick
Held jury unanimity rule announced by Supreme Court in Ramos does not apply retroactively to cases on state collateral review but prospectively under state constitutional amendment
ACLU of Nevada v. The County of Nye
Writ issued mandating county and county clerk adopt and refrain from certain procedures related to ballot counting and the role of observers during the ballot counting process
Kohlhaas v. State
Held that ballot initiative adopting nonpartisan primary election and ranked-choice voting did not infringe on voting rights, political parties’ associational rights, or other constitutional provisions
Welter v. Board of Registration in Medicine
Ruled state board suspension of medical license for false advertising did not violate doctor’s substantive due process rights under federal and state constitutions
Vlahos v. State
Ruled that the court did not abuse its discretion by allowing a juror to remain on the jury because defendant waived the claim by not objecting before the return of the verdict
Kingfisher Wind, LLC v. Wehmuller
Ruled production tax credits used to build a wind farm are intangible personal property and thus exempt from ad valorem taxation under amendment to Oklahoma Constitution
Associated General Contractors of Washington v. State
Ruled that a bill modifying how the Department of Labor and Industries calculated prevailing wage rates for public works projects was not an unconstitutional delegation of legislative authority
Statler v. State
Ruled statute proscribing sexual battery as a general intent crime not requiring defendant’s knowledge as to complainant’s nonconsent is constitutional under due process clause
State v. Thompson
Ruled police’s continued seizure of defendant’s cell phone without a warrant was not reasonably necessary to its investigation and violated unreasonable search and seizure protections
