North Carolina NAACP v. Moore
North Carolina Supreme Court ruled principles of popular sovereignty and democratic self-rule impose limits on the authority of legislators elected from unconstitutionally racially gerrymandered districts to initiate the process of amending the constitution. The state high court remanded to the trial court to apply a test it created to determine the validity of the two amendments at issue. On remand, applying that test, as well as the state high court’s subsequent decision in Holmes v. Moore, the trial court upheld the amendments.
