Voces de la Frontera v. Gerber
An original action accepted by the Wisconsin Supreme Court alleging sherriffs who honored immigration detainer requests, holding individuals in jail beyond when they would otherwise be released under state law to give ICE time to take them into custody, acted outside the scope of their arresting authority. The defendants sought to remove the case to federal court, but a federal district court remanded the case. The Wisconsin high court has stayed the matter while the defendants appeal that remand decision to a federal appellate court.
